Terms of Use
Effective November 3, 2026
These Terms of Use (the “Terms”) are a legal agreement between you and myMAK.ai (“myMAK.ai”, “we”, “us”). They cover the myMak apps for desktop and mobile, MAK (the assistant inside them), the website at mymak.ai, and any related services, updates and support (together, the “Service”). By creating an account, installing, or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.
Please read section 18 (Disputes). If you live in the United States, it requires most disputes to be resolved by individual arbitration and waives class actions, unless you opt out within 30 days. Sections 15 and 16 limit our responsibility. Nothing in these Terms takes away rights that the consumer laws where you live give you and that cannot be waived.
1. Who we are
In short: myMAK.ai makes myMak. Write to us at support@mymak.ai.
The Service is provided by myMAK.ai. You can reach us at support@mymak.ai. When these Terms say “you”, they mean the person using the Service; if a parent or guardian accepts these Terms for a teen, “you” also includes that parent or guardian where the context requires.
2. Who can use myMak
In short: You must be 13 or older. Under 18, a parent or guardian must agree too. myMak is invite only for now.
- Age. You must be at least 13 years old, or older if the law where you live sets a higher minimum age to use a service like this without a parent’s consent (for example, up to 16 in some European countries). myMak is not for children under 13, and we do not knowingly allow them to use it.
- Under 18. If you are under 18 (or under the age of majority where you live), you may use myMak only with the permission of a parent or legal guardian who has read and agreed to these Terms for you. The parent or guardian is responsible for your use of the Service.
- Invitations. While myMak is invite only, you need a valid invitation. We may decline, limit or withdraw invitations at our discretion.
- Legal capacity and restrictions. You must be able to form a binding contract (or have a parent or guardian do so for you), and you must not be barred from using the Service under the laws that apply to you, including sanctions and export laws. You may not use the Service if you are located in, or ordinarily resident in, a country or region subject to comprehensive sanctions by Canada, the United States, the United Kingdom or the European Union, or if you are on a government list of restricted persons.
- For yourself. Accounts are for individuals. If you use the Service for an organisation, you confirm you have authority to bind it, and “you” includes it.
3. Your account
In short: Keep your email and devices secure. You’re responsible for what happens in your account.
- You sign in with a one-time code sent to your email. myMak never asks for a password. Keep access to your email account and devices secure, and don’t share sign-in codes with anyone.
- Give accurate information, including your age group, and keep it up to date. Providing a false age is a breach of these Terms.
- You are responsible for all activity in your account, except activity caused by our own failure to take reasonable security measures. Tell us right away at support@mymak.ai if you think someone else has accessed your account.
- Don’t sell, transfer or let others use your account.
- Before you can send a sign-in code, a quick automated check (Cloudflare Turnstile) confirms you are a person. Don’t try to get around it.
4. The Service
In short: myMak is free and still early. Features can change, and we can pause or stop the Service.
- Free, early-access service. myMak is currently free and in an early, invite-only stage. Some features are experimental, may not work as described, and may be changed or removed.
- Changes. We may change, suspend or discontinue all or part of the Service at any time. If we stop the Service entirely, we will try to give at least 30 days’ notice and a way to export what we keep about you, unless that is not possible for legal, safety or security reasons.
- Updates. The apps may download and install updates automatically. Updates are signed by us so the app only installs genuine releases. Some features may not work without the latest version.
- No fees today. We do not charge for myMak. If we ever introduce paid features, we will tell you the price and terms before you are charged, and you will not be charged without agreeing.
- Your devices and connections. You are responsible for the devices, operating systems and internet connection you use, and for any charges from your mobile or internet provider.
5. AI answers
In short: MAK is an AI. It can be wrong, incomplete or out of date. Check anything important, and don’t use it for medical, legal, financial or safety decisions.
- You are talking to AI. MAK and the answers it gives (“Outputs”) are produced by artificial intelligence models, most of which are run by other companies (see section 8). MAK is not a person and does not have human judgment.
- Outputs can be wrong. Outputs may be inaccurate, incomplete, offensive, biased, out of date, or may seem confident while being wrong. They may not be unique: other people may receive similar Outputs. You must evaluate every Output for accuracy and suitability before you rely on it, use it or share it.
- Not professional advice. Outputs are not medical, mental-health, legal, financial, tax, investment, engineering or other professional advice, and do not create any professional relationship. Always consult a qualified professional. In an emergency, contact your local emergency services.
- No high-stakes decisions. Do not use the Service, on its own, to make decisions that have legal or similarly significant effects on people, such as decisions about credit, employment, housing, insurance, education, healthcare, legal status, or access to essential services.
- Safety features. MAK includes safety features such as content filters, gentler answers for teens and Tutor mode. These reduce risk but cannot catch everything, and they are not a substitute for supervision, judgment or professional help.
6. Actions you approve
In short: MAK asks before it sends, deletes, posts or spends. When you approve an action, it’s your decision and your responsibility.
- myMak can use tools that take actions for you, such as reading web pages, writing files or using services you connect. MAK asks for your approval before any action that sends, deletes, publishes, or spends money or credits, and shows you what it intends to do.
- Read each approval request carefully. When you approve an action, you instruct us and the relevant tool to carry it out, and you are responsible for that action and its results, including any messages sent, content published, files changed or deleted, and costs incurred with third parties.
- Actions can fail, run partially, or have effects you did not expect, and some cannot be undone. Keep backups of anything important. To the fullest extent the law allows, we are not responsible for losses caused by actions you approved or by tools and services you chose to connect.
7. Your content
In short: What you type and what MAK gives you are yours. We don’t claim them, and your chats stay on your device.
- Ownership. As between you and us, you keep any rights you have in what you type, say or upload (“Inputs”), and, to the extent we have any rights in them, we assign to you our rights in Outputs. We make no promise that Outputs are protected by copyright or free of other people’s rights.
- Where it goes. Your chats are stored on your device, not on our servers. When you send a message, it goes from your device to the AI provider you chose (see section 8). We keep your account details and settings as described in the Privacy Policy.
- Permission you give us. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process and transmit the content you choose to store with the Service (such as your settings, saved tools, invitations and reports) only as needed to run, secure and support the Service, and to comply with the law. We do not use your content to train AI models.
- Your responsibility. You confirm that you have the rights and permissions needed for your Inputs and that your Inputs and your use of Outputs do not break the law or these Terms or infringe anyone’s rights. Don’t enter other people’s personal information unless you are allowed to.
- Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.
8. Other companies’ services
In short: myMak connects you to AI models and tools run by other companies. Their terms apply too, and we don’t control them.
- AI providers. myMak sends your messages to AI models through OpenRouter, using an OpenRouter account and key that belong to you, or to other providers you add. Those companies, and the companies that make the models, process your messages under their own terms and privacy policies, which you must accept and follow. Some free models may keep or learn from what you send.
- Tools and connectors. Tools, servers, plugins and services you add or connect (including those on our starter list) are run by third parties. Their descriptions and results come from them, not us.
- No responsibility for third parties. We do not control, endorse or guarantee any third-party service, model, tool, website or content, and, to the fullest extent the law allows, we are not responsible for their availability, accuracy, security, costs, or how they use your data. Your dealings with them are between you and them.
9. Rules for using myMak
In short: Don’t use myMak to break the law, hurt people, or attack or abuse the Service.
You must not use the Service, or help anyone else use it, to:
- break any law or regulation, or infringe anyone’s intellectual property, privacy, publicity or other rights;
- create, request, store or share any content that sexualises minors, or groom, exploit or endanger children in any way (we report such content to the authorities where required or allowed);
- harass, threaten, bully, defame, stalk or intimidate anyone, or promote violence, terrorism, self-harm or hatred against people based on protected characteristics;
- plan or carry out violent, criminal or dangerous activity, including developing weapons capable of mass casualties (biological, chemical, nuclear or radiological), or obtaining controlled goods illegally;
- create or spread malware, phishing, spam or scams, or attack, probe or break into any system, network or account without authorisation;
- deceive people, including impersonating others, creating deepfakes of real people without consent, misrepresenting AI-generated content as human-made where that misleads, or running disinformation or election-interference campaigns;
- use subliminal, manipulative or deceptive techniques, or exploit people’s vulnerabilities (such as age or disability), to distort their behaviour in harmful ways; carry out social scoring; or infer sensitive traits or emotions from biometric data, or build facial-recognition databases by scraping images;
- make automated decisions with legal or similarly significant effects on people without meaningful human review (see section 5);
- collect, scrape or process personal data unlawfully, or track or monitor anyone without their consent;
- get around, disable or interfere with any safety, security, content-filtering, age or Tutor-mode feature, the person check, rate limits, or any approval step;
- copy, modify, reverse engineer, decompile or disassemble the Service, except where the law allows this despite this restriction;
- access the Service by automated means other than the interfaces we provide, overload it, or interfere with its operation or other users;
- use the Service or its Outputs to develop or train a competing AI product, or resell or sublicense the Service; or
- use the Service in high-risk settings where failure could lead to death, injury or serious environmental or property damage, such as operating vehicles, aircraft, medical devices, critical infrastructure or weapons.
You must also follow the usage policies of the AI providers and tools you use. We may investigate suspected breaches and take any action we consider appropriate, including removing content, suspending accounts, and cooperating with law enforcement.
10. Teens, families and Tutor mode
In short: For anyone under 18, MAK acts as a tutor and keeps answers suitable for their age. Parents stay responsible for supervision.
- Tutor mode. For accounts in the 13 to 17 age group, Tutor mode is always on: when a question looks like homework or a test, MAK explains, coaches and asks guiding questions instead of giving the answer. A teen cannot switch it off or change their own age group. Tutor mode helps support academic honesty but cannot detect every case; students remain responsible for following their school’s rules.
- Family accounts. A parent or guardian may invite a child and manage that child’s settings, such as quiet hours, study hours and content filters. Parents and guardians are responsible for deciding whether myMak is suitable for their child, for supervising its use, and for the settings they choose.
- Not a substitute for supervision. Safety features reduce risk but cannot guarantee that a young person will never see something unsuitable.
11. The app licence
In short: You may install and use the app for yourself. You don’t own it, and you must follow these Terms.
- Subject to these Terms, we give you a personal, limited, revocable, non-exclusive, non-transferable licence to download, install and use the myMak apps on devices you own or control, for your own use.
- The apps include open-source components that are licensed under their own terms, which are listed in the app. Where an open-source licence gives you rights that these Terms would otherwise limit, the open-source licence prevails for that component.
- Download myMak only from mymak.ai, our releases page, or an app store we name. Copies from anywhere else may be unsafe, and we are not responsible for them.
- You must comply with all export-control and sanctions laws that apply to the apps.
12. Our names and designs
In short: myMak, MAK and our designs belong to us.
The Service, including the software, the names myMak and myMAK.ai, MAK and its likeness, logos, designs and website content, is owned by myMAK.ai or its licensors and protected by intellectual property laws. Except for the licence in section 11, these Terms give you no rights in them. You may not use our names, logos or MAK in a way that suggests endorsement or causes confusion without our written permission.
13. Copyright and content complaints
In short: If you believe something on our website or in the Service infringes your rights or is illegal, tell us.
Send notices to support@mymak.ai with: your contact details; a description of the work or right concerned; where the material is located; a statement that you have a good-faith belief the use is not authorised or the content is illegal (with reasons); a statement that your notice is accurate and, for copyright, that you are the owner or authorised to act for the owner; and your physical or electronic signature. We will review notices promptly, may remove or disable access to material, and may suspend repeat infringers. Where the law requires (including under the U.S. Digital Millennium Copyright Act, Canada’s notice-and-notice regime and the EU Digital Services Act), we will follow the procedures it sets, including telling the affected user and allowing a response. This address is also our single point of contact for authorities and users under the EU Digital Services Act; we communicate in English and French.
14. Suspension and ending
In short: You can stop any time and delete your account. We can suspend or close accounts that break these Terms or put others at risk, and you can appeal.
- By you. You may stop using the Service at any time and delete your account in Settings. Deletion becomes final after 7 days, during which you can undo it.
- By us. We may suspend or end your access, with or without notice, if we reasonably believe you have broken these Terms or the law, your use creates risk or harm for others, us or the Service, we must do so by law, or your account has been inactive for over a year (after notice). Where reasonable, we will tell you why and give you a chance to fix the problem.
- Appeals. If you think we suspended or closed your account by mistake, write to support@mymak.ai within 60 days. A person will review your appeal.
- What continues. Sections 7 (licence and feedback), 12, 15, 16, 17, 18, 22 and any other terms that by their nature should survive will continue after these Terms end.
15. No warranties
In short: We provide myMak as it is, without promises that it will be error-free or always available.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE, INCLUDING ALL OUTPUTS, ACTIONS AND THIRD-PARTY SERVICES, IS PROVIDED “AS IS” AND “AS AVAILABLE”, AND YOU USE IT AT YOUR OWN RISK. MYMAK.AI AND ITS AFFILIATES, LICENSORS AND SUPPLIERS DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT ANY OUTPUT IS ACCURATE, COMPLETE, SAFE OR SUITABLE FOR ANY PURPOSE, OR THAT ANY CONTENT OR DATA WILL BE PRESERVED.
16. Limits on our liability
In short: If something goes wrong, our responsibility is limited, as far as the law allows. Some laws don’t allow these limits, and then they don’t apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) MYMAK.AI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR OPPORTUNITY, OR COSTS OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICE, ANY OUTPUT, ANY ACTION YOU APPROVED, ANY THIRD-PARTY SERVICE, OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS (CAD $100). THESE LIMITS APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
What we don’t limit. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for gross negligence or intentional misconduct where the law does not allow that liability to be limited, or your statutory rights as a consumer. If you live in the European Union, the United Kingdom or Quebec, see also section 19.
17. Indemnity
In short: If someone makes a claim against us because of how you used myMak or broke these Terms, you cover our costs, where the law allows.
To the extent permitted by law, you will defend, indemnify and hold harmless myMAK.ai and its affiliates, officers, directors, employees and agents from any third-party claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms, your Inputs, your use of Outputs, actions you approved, or your violation of any law or anyone’s rights. We will tell you about the claim and may take control of its defence at our own cost. This section does not apply to consumers where local consumer law prohibits it, including in Quebec.
18. Disputes
In short: Talk to us first. Where you live decides which law and which courts apply. In the US, disputes go to individual arbitration unless you opt out.
18.1 Talk to us first
Most problems can be solved quickly. Before starting any formal proceeding, you and we each agree to send the other a written notice describing the dispute and the remedy sought (yours to support@mymak.ai; ours to your account email) and to try in good faith to resolve it informally for 60 days. Time limits for bringing claims are paused during that period, to the extent the law allows.
18.2 Governing law and courts
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules, and, subject to the rest of this section, disputes will be heard exclusively by the courts of the Province of Ontario, sitting in Toronto, and you and we submit to their jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply. However:
- Consumers in Canada keep the protection of the consumer laws of the province or territory where they live, and may bring claims in its courts. Nothing in these Terms requires a consumer in Ontario, Quebec or any other province to arbitrate or waives their right to take part in a class action where their consumer law prohibits that.
- Consumers in the European Union, the United Kingdom and Switzerland keep the protection of the mandatory laws of the country where they live and may bring claims in its courts. EU consumers may also use their national alternative dispute resolution bodies.
- Residents of the United States: section 18.3 applies, and the Federal Arbitration Act governs it.
- Everyone else: the governing law and courts above apply, except where the law where you live gives you a right to sue at home that cannot be waived.
18.3 United States: individual arbitration and class action waiver
If you live in the United States, you and myMAK.ai agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service (including whether this section applies or is enforceable) will be resolved by final and binding individual arbitration, not in court, except that: (a) either of us may bring an individual claim in small-claims court if it qualifies; and (b) either of us may seek an injunction in court to stop infringement or misuse of intellectual property.
- How. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, and may be conducted by video, phone or written submissions. For claims of US $10,000 or less, we will pay all filing, administrative and arbitrator fees unless the arbitrator finds your claim frivolous. The arbitrator may award the same individual relief a court could, but only to you individually.
- Class action waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL. If this waiver is found unenforceable for a claim, that claim (and only that claim) must be decided in court, after any individual arbitration has finished.
- Mass filings. If 25 or more similar demands are filed by or with the help of the same law firm or coordinated group, they will be administered in batches of up to 25, with one arbitrator per batch, and the remaining claims paused, to the extent the administrator’s rules allow. Time limits are paused for paused claims.
- Opting out. You may opt out of this section 18.3 by emailing support@mymak.ai within 30 days after you first accept these Terms (or within 30 days after we materially change this section), with your name, account email and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
- Severability. If any part of this section 18.3 is found unenforceable, the rest remains in effect, except as stated for the class action waiver.
18.4 Time to bring claims
To the extent permitted by law, any claim must be brought within one year after it arises; otherwise it is permanently barred. This limit does not apply to consumers in Quebec or where the applicable law prohibits it.
19. Regional terms
In short: Some places give you extra rights. Those always win over anything in these Terms.
- European Union, EEA, United Kingdom and Switzerland. If you are a consumer living there, sections 15, 16 and 17 apply only to the extent permitted by your local law. We are responsible for foreseeable loss and damage caused by our breach of these Terms or our failure to use reasonable care and skill, but not for loss that was not foreseeable or that relates to any business use. You keep your statutory rights for digital content and services. Nothing in section 16 limits our liability under applicable product liability laws.
- Quebec. If you are a consumer in Quebec, the Consumer Protection Act and the Civil Code of Québec apply in addition to these Terms; any clause that excludes or limits our liability, requires arbitration, or waives class actions does not apply to you to the extent prohibited by that Act. These Terms are presented to you in French first: version française.
- Australia and New Zealand. Our services come with guarantees that cannot be excluded under the Australian Consumer Law and the New Zealand Consumer Guarantees Act. Nothing in these Terms excludes, restricts or modifies those guarantees.
- United States. Some states do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages, so parts of sections 15 and 16 may not apply to you. California residents: under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. New Jersey residents: nothing in these Terms limits rights under the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act.
20. App stores
In short: If you get myMak through Apple or Google, these extra terms apply.
If you obtain the app through Apple (including the App Store or TestFlight) or Google Play: these Terms are between you and myMAK.ai only, not the store provider; we, not the store provider, are responsible for the app, its maintenance, support, and any product, legal-compliance or intellectual-property claims; the store provider has no obligation to provide maintenance or support; to the maximum extent permitted by law the store provider has no warranty obligation for the app; you must also follow the store’s terms; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a sanctioned country or on a restricted-party list.
21. Changes to these Terms
In short: If we make a significant change, we’ll tell you at least 30 days before it takes effect.
We may update these Terms to reflect changes to the Service, the law or our practices. For changes that materially reduce your rights or increase your obligations, we will give you at least 30 days’ notice by email or in the app before they take effect, showing the new or changed clause and the clause it replaces; other changes take effect when posted. If you don’t agree to a change, stop using the Service and delete your account before it takes effect; if you are a consumer in Quebec, you may also end the contract at no cost. If you keep using the Service after a change takes effect, you accept the updated Terms. Changes do not apply to disputes that arose before they took effect.
22. General terms
- Entire agreement. These Terms, the Privacy Policy and any terms shown to you for specific features are the whole agreement between you and us about the Service, and replace any earlier agreements on the subject.
- Severability. If a court finds any part of these Terms unenforceable, that part will be enforced to the maximum extent possible and the rest will remain in effect.
- No waiver. If we don’t enforce a right, we have not given it up.
- Assignment. You may not transfer these Terms without our consent. We may transfer them to an affiliate or as part of a merger, acquisition or sale of assets, and we will tell you if that happens.
- Events outside our control. We are not responsible for delays or failures caused by events beyond our reasonable control, including outages of third-party services, internet failures, power failures, natural disasters, war, labour disputes or government action.
- Notices. We may send notices to the email address on your account or in the app. You may send notices to support@mymak.ai.
- No third-party beneficiaries, except as stated in section 20.
- Language. These Terms are available in English and French, and both versions are equally authoritative. In Quebec, the French version is presented to you first; you may then choose to be bound by the English version.
- Headings and summaries. Headings and “In short” summaries are for convenience and do not affect how these Terms are interpreted.
